EU member states set penalties, but they must be “effective, proportionate and dissuasive.” Expect significant fines for late reporting, incorrect data, or insufficient certificate surrender. Some countries are considering criminal penalties.

The EU plans to review scope expansion by 2026, potentially adding chemicals, plastics, and other carbon-intensive sectors by 2030. The mechanism may also extend to indirect emissions and downstream products as the system matures.
